On June 5, 2026, the President of the Board of Directors of the National Seed Institute (INASE for its acronym in Spanish) and the Secretariat of Agriculture, Livestock and Fisheries executed a Joint Resolution (published in the Official Gazette on June 8, 2026), establishing a protocol for the control of varietal identity in grain based on samples taken at the first point of delivery, under the framework of Law No. 20,247 on Seeds and Phytogenetic Creations. The resolution amends INASE Resolution 207/2016 and applies to cultivars registered in the National Cultivar Registry and the National Cultivar Property Registry as from its publication date, which constitutes a direct incentive for the introduction of new high-value genetic varieties into the Argentine market.

The main aspects regulated by the resolution are the following:

-Eligible establishments. First points of grain delivery (grain elevators, oil processing plants, cooperatives and similar facilities) must be registered in the Argentina’s agricultural information and registration system (SISA for its acronym in spanish) pursuant to Joint General Resolution 4,248/2018 and Joint General Resolution 5,673/2025.

-Sample collection. Sample collection is governed by pre-existing technical procedures. The manager of the establishment may enter into agreements with grain trade entities or other private parties to fund collection activities and coordinate sample delivery logistics.

-Entities authorized to conduct analysis. Only Arbitration Chambers and private entities that have executed agreements with INASE or hold express authorization from the agency may analyze the samples, ensuring the technical reliability of results.

-Sample preservation. Both the analyzed portion and the backup sample must be preserved for 60 consecutive days from the date of issuance of the analysis certificate, a period that coincides with the timeframe available for filing complaints.

-Communication of results. Results must be transmitted immediately and simultaneously to the holder of the varietal right and, for informational purposes, to the holder of the analyzed sample.

-Complaints and available actions. The holder of the varietal right has 60 consecutive days from the date of the certificate to file a complaint with INASE, which automatically suspends the sample preservation period. The rights holder may also pursue civil or criminal actions concurrently.

-Sanctions. Non-compliance is subject to penalties under Article 38 of Law No. 20,247, which provides for warnings, fines, and suspension or cancellation of registry registrations.
