On January 16, 2025, Resolution No. 11/2025 (the “Resolution”) of the Ministry of Economy was published in the Official Gazette. This Resolution states specific procedures for the implementation of the Private Initiatives Database (known by its Spanish acronym, “BIP”) which it will be available in the website https://www.argentina.gob.ar/economia.
The Private Initiative Regime —regulated by Decree No. 713/24—provides certain incentives for individuals or entities presenting projects related to Public Works (Law 13,064), Public Works Concessions (Law 17,520), State Reform (Law 23,696), and Public-Private Partnership Contracts (Law 27,328). If the project submitted by the individual or entity is declared to be of public interest, the proponent is granted a right of preference in the selection process conducted by the State. Moreover, if a third party is awarded the project, the proponent of the initiative is entitled to compensation.
The main objective of this regulation is to encourage the submission of private initiatives aimed at developing public works, infrastructure, and public services in areas of public interest and the intention is to ensure that the financing for such projects originates from private sources.
The Resolution designates the Compliance and Process Control Directorate, under the General Directorate of Document Management, Transparency, and Access to Information, as the authority responsible for managing the BIP, where information provided by the recipient organization of the initiative or the competent authority in the matter will be published.
The BIP will publish, at a minimum, the following information about each submitted project: (i) The person who submitted the initiative. (ii) The submission date. (iii) The project name. (iv) The involved productive sector. (v) The status of the procedure. (vi) A summary with the most relevant project details.
(vii) Reports related to the project issued by competent authorities in the matter.
