Dear Sir or Madam,
Resolution No. 76/2020 of the National Institute of Industrial Property (INPI) (the “Resolution”), published in the Official Gazette on July 18, 2020, establishes a transitional electronic notification regime as a consequence of the paralysis of personal and physical notifications as a result of the social, preventive and compulsory isolation measure.
Indeed, the Resolution provided that, regarding patents, the official actions, summons, and notifications issued in the preliminary or in the substantial stage, as well as any interlocutory act and all final administrative acts issued during the course of the substantiation, will be notified to the electronic address established in the INPI Procedures Portal.
In addition, the Resolution established that in all cases the computation of the terms will be counted as from the day following the publication of the list of the Application Numbers in the Patent Notification Bulletin, which will be issued later, in a weekly edition, and made available to the public on the INPI’s website. Likewise, priority certificates and status certificates will be made available on the said website.
This regime will be in force until the electronic notification procedure referred to in INPI’s Resolution No. 250/2018 is regulated.
