Dear Sir or Madam,
Decree of Necessity and Urgency No. 690/2020 (the “Decree”), published in the Official Gazette on August 22, 2020, modifies the Argentine Digital Law No. 27,078. By means of the Decree, Information Technology and Communications Services (ICT) were declared essential and strategic public services in competition.
The Decree established that ENACOM, as the enforcement authority of the Argentine Digital Law, must establish the mandatory universal basic provision and guarantee the effective availability of ICT Services.
Likewise, the mobile telephony service was declared a public service in all its forms, with the obligation for ENACOM to determine the prices of said services and establish the mandatory universal basic provision of the same.
Finally, the Decree ordered the suspension of any price increase or modification, established or announced from July 31 to December 31, 2020, by the ICT licensees, including subscription broadcasting services through a physical link or radioelectric, those corresponding to the fixed or mobile telephony service in any of its modalities, and satellite television services by subscription.
