On November 17, 2025, through Decree 810/2025 (the “Decree”), the National Executive Branch ordered the provisional appointment of the members of the National Competition Authority (“NCA”).

The NCA is the decentralized and self-governed agency created by Law No. 27,442 (the “Law”), responsible for enforcing and overseeing compliance with competition legislation. The measure is issued following the completion of a Public Competitive Examination of Background and Opposition (carried out pursuant to the Regulations approved by Joint Resolution No. 1/2019 and its amendments, and Resolutions of the Secretariat of Industry and Trade Nos. 93/2025, 119/2025, and 291/2025). However, the appointment of the NCA members must still be confirmed by the Senate.

Designated Positions

Pursuant to the Decree, the following individuals were provisionally appointed:

-President of the Competition Tribunal: Eduardo Rodolfo Montamat

-Member of the Competition Tribunal: Lucas Gabriel Trevisani Vespa

-Member of the Competition Tribunal: Marcelo Rubén D’Amore

-Secretary for Anticompetitive Conduct Investigations: Ana Julia Parente

-Secretary for Merger Control: Germán Augusto Zamorano

According to Article 18 of the Annex to Decree 480/2018, the NCA is deemed legally constituted upon the appointment of the President, the first two Members of the Tribunal, and the Secretaries for Anticompetitive Conduct Investigations and Merger Control, and it begins to exercise its functions immediately after its constitution.

This regulation has an additional significant consequence: it triggers the one-year period after which “ex-ante” merger control will begin to apply (under which no transaction may be closed without prior authorization from the ANC).
