International Trade & Customs Department Report | Decree 38/2025

Dear all:

On January 27, 2025, the present Decree was published in the Official Gazette. Through this Decree, the Export Duty (E.D.) rate is reduced to 0% for goods classified under the tariff codes listed in Annex I, which forms part of the Decree. Additionally, a reduction of the Export Duty is established – until June 30, 2025 – for the tariff codes listed in Annex II, which is also an integral part of the Decree.

Furthermore, it is stipulated that entities exporting goods covered under Law No. 21,453 and its amendments (regulations for agricultural products) will be eligible for the reduction of duty rates provided they liquidate at least ninety-five percent (95%) of the foreign exchange within a period from the effective date of this measure until fifteen working days after the Foreign Sales Affidavit is filed, whether through export payments, liquidation advances, or cases of external pre-financing and/or post-financing. Otherwise, they will be subject to the Export Duty rate applicable the day before the effective date of this measure.

The measure further establishes in Article 5 that the Central Bank, the Secretariat of Agriculture, Livestock, and Fisheries of the Ministry of Economy, and the Customs and Revenue Control Agency will issue, within their respective competences, the necessary regulations for the effective implementation of the provisions outlined here.

The provisions of the measures announced herein will take effect starting January 27, 2025.

We remain at your disposal for any inquiries.

Sincerely,

Guido H. Krolovetzky
