Dear Sir or Madam,
Last Wednesday, April 8, 2020, the Agency for Access to Public Information (the “AAIP”) issued through its website a statement that provides some advice to protect personal data on the existing video call platforms.
The AAIP advises that each time you enter a platform to make or participate in a video call, the following recommendations should be taken into account:
• Read the privacy policies and conditions of the mobile applications or platforms, which should ask the user for their consent to process their personal data, which must be in writing or by other similar means, in a clear and simple manner.
• On some occasions, when the product is “free”, the company that owns the platform may end up using users’ personal data for other purposes. For this reason, the AAIP reminds that companies have to inform the user in advance what these other purposes are and their consequences, the recipients and, in the event that they are stored in a database, the name and contact details of the person responsible for the database, so that users can exercise their rights
• If a video call is recorded, the user must be previously informed, explicitly and concretely, together with the purpose of the use of those images.
• The AAIP recommends the use of platforms that allow you to put a password to rooms or calls, in addition to an identification (ID) that only people invited to participate have.
Finally, the AAIP reminds that Law No. 25,326 on the Protection of Personal Data recognizes and guarantees the rights of the data owners who can make a claim before the National Directorate for the Protection of Personal Data of the Agency in the event of a breach to said Law.
