On Friday, March 14th, the official gazette published the guidelines for the public competition that is being launched for selecting the officers who will integrate the National Competition Authority, in accordance with Article 18 of Law 27.442 (“LDC”). This is the first step for creating this new agency, that will include the Competition Court, the Secretariat in charge of infringements, and the Secretariat in charge of merger control. The National Competition Authority will be a decentralized and self-sufficient agency operating within the national Executive Branch with the purpose of applying and overseeing compliance with the LDC. The positions included in the contest are the five members of the competition court, a Secretary who will act as a prosecutor in connection with potential infringements and a Secretary who will act as a prosecutor in connection with merger control.
