Estimados:
El Decreto N°785/2020 fija, hasta el 31 de diciembre de 2021, la alícuota de los derechos de exportación para minería en el ocho por ciento (8%) para las posiciones arancelarias de la Nomenclatura Común del Mercosur (N.C.M.) listadas en su Anexo (el “Decreto”).
El propósito del Decreto es reglamentar el artículo 52 de la Ley N°27.541, que establece un tope para los derechos de exportación correspondientes a la industria minera —principalmente, ajustando la alícuota aplicable al tope establecido-. Así, se reduce el derecho de exportación de determinadas mercaderías, del 12% al 8%, hasta el 31 de diciembre de 2021.
La Ley N°22.415 (Código Aduanero), mediante el artículo 755 y sus modificaciones, facultó al Poder Ejecutivo Nacional a modificar los derechos de exportación establecidos.
El Decreto se emite en pos de brindar previsibilidad y certidumbre, con un claro sentido de progresividad tributaria.
Detrás del Decreto se observa que tanto la solvencia fiscal como el desarrollo del sector minero resultan objetivos complementarios, y en el entendimiento que de la inversión se generarán los recursos fiscales que permitan lograr la mentada solvencia y, asimismo, compensarse las asimetrías existentes en el sector productivo.
El Decreto señala que resulta necesario continuar analizando las brechas estructurales existentes en el sector, con el propósito firme de alcanzar una mayor equidad, progresividad e inclusión tributaria compatible en un todo con el desarrollo del potencial minero argentino.
El artículo 1 del Decreto fija hasta el 31 de diciembre de 2021, un derecho de exportación del ocho por ciento (8%) a la exportación de las mercaderías comprendidas en las posiciones arancelarias de N.C.M., conforme el detalle contenido en el Anexo del Decreto.
El artículo 2 del Decreto deja sin efecto lo dispuesto en los Decretos N°1126 de fecha 29 de diciembre de 2017 y N°793 de fecha 3 de septiembre de 2018, en relación con las posiciones arancelarias incluidas en el artículo 1º del presente Decreto.

Decree No. 785/2020 | Cut in mining export rights from 12% to 8% until December 31, 2021
Dear Sir or Madam,
Decree No. 785/2020 sets, until December 31, 2021, the rate of mining export duties at eight percent (8%) for the tariff positions of the Mercosur Common Nomenclature (N.C.M.) listed in its Annex (the “Decree”).
The purpose of the Decree is to regulate Law No. 27,541, Section 52, which establishes a cap for export rights corresponding to the mining industry -mainly by adjusting the rate applicable to the established cap-. Thus, the export duty for certain goods is reduced from 12% to 8% until December 31, 2021.
Under Law No. 22.415 (Customs Code), Section 755, and its amendments, the Federal Executive Branch was empowered to amend the established export duties.
The Decree is issued in order to provide predictability and certainty, with a clear sense of tax progressiveness.
The reasons behind the Decree can be found in the fact that both fiscal solvency and the development of the mining sector are complementary objectives, and in the understanding that investment will generate the fiscal resources that will allow the aforementioned solvency to be achieved and also compensate the existing asymmetries in the productive sector.
The Decree underlines that it is necessary to continue analyzing the existing structural gaps in the sector, with the firm purpose of achieving greater equity, progressiveness, and tax inclusion compatible with the development of Argentina’s mining potential.
Under Section 1, the Decree fixes until December 31, 2021, an export duty of eight percent (8%) for the export of goods included in the tariff positions of N.C.M., according to the details set out in the Annex of the Decree.
Pursuant to Section 2 revokes the provisions of Decree No. 1126 dated December 29, 2017 and Decree No. 793 dated September 3, 2018, in relation to the tariff positions approved by the Decree, Section 1.
