On February 25, 2025, the Ministry of Economy, through the Secretariat of Industry and Commerce, approved Resolution 16/2025 (the “Resolution”), which establishes a new Technical Regulation for electrical equipment marked in Argentina. This regulation aims to simplify and update existing standards, ensuring costumer protection.

1- Key Aspects of Resolution 16/2025

1.1- Creation of the Technical Regulation

The Resolution establishes a technical regulation detailing the essential quality and safety requirements that electrical equipment marketed in the territory of the Argentine Republic must meet. This regulation is detailed in Annex I of the Resolution.

1.2- Scope

The requirements of the Resolution apply to a wide range of electrical products, simplified in Annex II. These products include power supplies and chargers, household electrical appliances, lightning devices, and electronic, audio, and video equipment.

1.3- Manufacturers and Importers

Manufacturers and importers of the mentioned products must ensure compliance with the established requirements through a Sworn Declaration of Conformity and follow the conformity assessment procedure detailed in Annex III.

1.4- Distributors and Retailers

Distributors and retailers, both wholesale and retail, must have a simple copy of the sworn declaration of conformity, in paper or digital format, to market and/or distribute the products. This copy must be displayed upon request.

1.5- Powers of the National Directorate of Technical Regulations

The National Directorate of Technical Regulations, operating within the Secretariat of Industry and Commerce, is authorized to modify the regulation concerning the covered products and to issue complementary and/or clarifying norms necessary to make provisions of the Resolution operational.

1.6- Sanctions

Violations of the provisions of the Resolution will be subject to sanctions as established by Law No. 24.240 and Decree No. 274 dated April 17, 2019. These sanctions may include criminal, civil, or administrative liabilities.

1.7- Transitional Provisions

Certificates that were issued under the previous technical regulation, which has been repealed by the new Resolution, will remain valid for a period of one year from the date the new Resolution comes into effect. During this transition period, manufacturers and importers of the affected products must make the necessary adjustments to ensure that their products comply with the new requirements and standards established by the new Resolution.

2- Annexes of the Resolution

2.1- Annex I: Essential Quality and Safety Requirements for Electrical Equipment

This annex details the definitions, general conditions, protection against hazards, and marketing requirements that electrical products must meet.

2.2- Annex II: Essential Quality and Safety Requirements for Electrical Equipmen

The annex includes a detailed list of products covered by the regulation, divided into four appendices:

-Appendix I: Power Supplies and Charges

-Appendix II: Household Electrical Appliances

-Appendix III: Lightning Devices

-Appendix IV: Electronic, Audio, and Video Equipment

2.3- Annex II: Essential Quality and Safety Requirements for Electrical Equipment

This annex establishes the conformity assessment procedure that the products mentioned in the appendices of Annex II must follow. Certification must be carried out according to items 1b, 2, 3, 4 and 5, which refer to the following conformity assessment procedures:

1- Sworn Declaration: Manufacturers and importers must submit a sworn declaration certifying that their products comply with the established requirements.

2- Product Certification: Products must be certified by recognized certification bodies, based on the test reports from accredited laboratories.

3- Laboratory Testing: Products must undergo testing in accredited laboratories to verify their conformity with applicable technical standards.

4- Certificate Validity: Product certificates are valid for two years, renewable through a surveillance statement.

5-Conformity Marking and Labeling: Products must bear a conformity mark and comply with the established labeling and marking requirements.
