Dear Sir or Madam,
Mining Secretariat Resolution No. 60/2021, published in the Official Gazette today, establishes that all filings to be filed before the Federal Mining Secretariat in regard to the Federal Mining Investment Law No. 24,196 (the “FMIL”) shall be submitted online.
No more in-person filings will be allowed to be filed before the Federal Mining Secretariat (“FMS”). Only online filings will be allowed. Even after the Covid pandemics is over.
It is relevant to point out that the communications from the FMS through the TAD online system shall be considered duly notified since its upload in the system, and that the companies which fail to notice this matter on time, could be subject to sanctions from the FMS.
Following the technological changes implemented by the Mining Secretariat, the Resolution establishes that all the affidavits required by the FMIL must be submitted digitally through the “Remote Procedures” (“TAD”), a platform under the sphere of the Electronic Documentary Management System.
The Resolution is mandatory for all beneficiaries registered in the FMIL Registry.
Furthermore, the Resolution establishes that any filing made other than through the digital means previously described will be considered invalid for the purposes of compliance with the obligations of FMIL and will enable the Enforcement Authority of the FMIL to impose the penalties provided for in the FMIL, Section 28.
The Resolution shall enter into force as of March 18th, 2021.
