Dear Sir or Madam,
Resolution No. 38/2020 of the National Institute of Industrial Property (the “Resolution”), published in the Official Gazette on April 28, 2020, establishes that:
1. The publication referred to in Article 12 of Law No. 22,362 on Trademarks and Trade Names, as amended, regarding trademark applications filed as of November 15, 2019, and that have not yet been published, will be exclusively made in Trademark Gazette edited by the National Trademark Office.
This is possible due to the fact that on November 15, 2019, the online entry of trademark applications was enabled, which allowed all the essential elements of a trademark application to be available in the computer system and which, in turn, allowed the generation of a Gazette without having to resort to contracting external services.
2. The Trademark Gazettes that are edited by external services will subsist with respect to those trademark applications filed prior to November 15, 2019, as well as for the publication of office actions and resolutions – while this form of notification continues-. These Gazettes will be published and will be made available simultaneously with the Gazettes edited by the National Trademark Office.
3. In order to avoid mistakes, all the Trademark Gazettes published by the National Trademark Office will be numbered sequentially and starting with number 10,000, continuing with the usual and correlative numbering for those that are edited through external services. Then, once the operational capacity to edit all the Gazettes has been implemented by the National Trademark Office, all the unused numbering for the Gazettes that had to be edited through external services will be canceled.
