Competition & Antitrust Department Report | Resolution No. 238/2021 – Domestic Trade Secretariat – SIFIRE

Domestic Trade Secretariat Resolution No. 238/2021, published today in the Official Gazette, creates a monitoring system on labels and signs (called SiFIRE) in products such as food, beverage, drinkable food, perfumery, personal hygiene, personal care, and home cleaning. The Resolution establishes that all labels and signs of these products must undergo an inspection procedure before the Undersecretary of actions for consumers defense (hereinafter, “the Undersecretary”) prior to its commercialization. For these purposes, certain documentation established in the Resolution must be provided through the TAD platform.

The approval by the Undersecretary must be granted within 10 business days from the filing. Once such a term has elapsed, a tacit approval will operate.

The Resolution will come into force on April 30th, 2021. This is relevant not only for the launch of new products or products with new labels or signs but also it could have an impact on products whose launch is imminent.
