Dear Sir or Madam,
Resolution No. 161/2023 (the “Resolution”) of the Agency of Access to Public Information (“AAIP”), published in the Official Gazette on August 30th, 2023, creates the “Program for transparency and protection of personal data in the use of Artificial Intelligence” (the “Program”) contained in its Annex I. The Program’s general objective is to promote processes of analysis, regulation, and strengthening of state capacities necessary to accompany the development and use of artificial intelligence (“AI”), both in the public and private sectors, ensuring the effective exercise of citizens’ rights in matters of transparency and personal data protection.
In addition, the Program contemplates the monitoring of regional and global advances of technological developments based on AI, the collaborative elaboration of regulatory strategies to address the violation of rights and prevent negative impacts of the use of AI, and promotes the creation of a Multidisciplinary Advisory Council with experts in the field, to foster social participation and governance through consensus and agreements on sectoral policies.
