On March 19th, 2021, the Resolution of the Ministry of Labor, Employment and Social Security No.142/2021 (the “Resolution”) was published in the Official Gazette referring to the imminent entry into force of Act No. 27,555 (“Legal Regime of the Remote Working Contract”) which will apply as of April 1st., 2021.
The Resolution establishes that as long as the restrictions and/or sanitary recommendations issued by the national, provincial, or local authorities are maintained, the circumstance in which the workers continue to work from home – according to the legal provisions or measures adopted by the employer to prevent risks of infection- cannot be considered as a voluntary adhesion to the Legal Regime of the Remote Working Contract.
