TMT (Telecoms, Media & Technology) Department report | ENACOM Resolution No. 802/2020: communication of information related to human trafficking and exploitation

Dear Sir or Madam,

Resolution No. 802/2020 of the National Telecom Regulatory Entity (ENACOM) (the “Resolution”), published in the Official Gazette yesterday, establishes that the holders of licenses, permits, and authorizations of audiovisual communication services and holders of news signal records, when they disseminate information related to the trafficking and exploitation of persons (both labor and sexual), must insert a socket for the television services or read in the case of radio broadcasting services the legend “If you are a victim or know someone who suffers the crimes of trafficking and exploitation of persons, you can call 145, 24 hours a day. It is a free, anonymous, and national line”.

Failure to comply with the provisions of the Resolution will give rise to the application of the sanctions provided in the Audiovisual Communication Services Law No. 26,522.

The Resolution nullifies Resolution No. 327-AFSCA / 14 that established the use and insertion of the socket as a recommendation by the enforcement authority.

Should you require any further information on this matter, please do not hesitate to contact us.

Sincerely,

Emilio Beccar Varela
