Dear Sir or Madam,

Joint Resolution No. 460/2021 (the “Resolution”) of the Ministry of the Chief of Cabinet of Ministers and the Ministry of Health of the Province of Buenos Aires, published in the Official Gazette of the Province of Buenos Aires on December 10th, 2021, approves the “COVID Free Pass” (the “Pass”).

The Pass is established as a requirement to attend those activities carried out in the provincial territory that represent a higher epidemiological risk, in addition to complying with the protocols, recommendations, and instructions of the health authorities. It will consist in the accreditation, by all people over 13 years old, of having obtained at least two doses of the vaccine against COVID-19, applied at least 14 days before, either through App “VacunatePBA”, App “Mi Argentina” or the vaccination card in cardboard or card format.

As of December 21st, 2021, the Pass must be provided for: (i) the execution of cultural, sports, religious and recreational activities in closed spaces: cultural centers gymnasiums, movie theaters, sporting events involving large crowds of people; party halls and night clubs, parties, weddings, events, and meetings with large crowds of people, weddings, events and meetings with a large number of people; bars and restaurants, (ii) carrying out in-person procedures before provincial and/or municipal public agencies and in-person procedures before private entities, when they imply a large number of people, (iii) workers who attend to the public, either in public or private entities.

This list of activities that require the Pass is merely enunciative and may be extended depending on the evolution of the epidemiological situation, the progress of vaccination, or the health authorities’ decision.

By virtue of this regulation, the organizers, owners, or persons in charge of the activities subject to the provisions of the Resolution, will oversee the accreditation of the Pass, at the entrances to said activities.

Finally, the Resolution provides that breaches to its provisions shall be sanctioned in accordance with Decree-Law No. 8,841/77 on sanctions for infringements to the provincial sanitary police regulations.
