Labor & Social Security Law Department Report | Ministry of Health and Ministry of Labor, Employment and Social Security Joint Resolution No. 4/2021: return to in-person work
Dear Sir or Madam,
On April 9th, 2021, Joint Resolution No. 4/2021 issued by the Ministry of Health and the Ministry of Labor, Employment, and Social Security came into force, authorizing employers to call employees to return to their in-person activities, including those over 60 years old, pregnant women, and persons of risk who have just been vaccinated against COVID-19 with the first dose according to the vaccines in use in the Argentine Republic.
The calling is to take place 14 days from the vaccination date.
Any health employees with a high risk of exposure, relieved from their duty of attendance to work due to being part of a risk group or to pregnancy, may be called 14 days after having completed the entire vaccination scheme.
The employees called must submit a document certifying the corresponding vaccination or they must state, through an affidavit, the reasons why they have not been vaccinated.
Resolution No. 627/2020 of the Ministry of Health exempts from this Resolution any person with immunodeficiency and any oncological and/or transplanted patient.
Please, do not hesitate to contact us should you require any further information on this matter.
Sincerely,
Alvaro J. Galli
