Public Law Report | National Communications Agency Resolution 304/2020: regulations on postal and package delivery services during the mandatory isolation measure.

Within the current sanitary emergency, the National Communications Agency (from the Spanish, Ente Nacional de Comunicaciones, “ENACOM”) issued Resolution 304/2020, which set forth that, as long as the mandatory isolation measure stated by Decree 297/2020 is in place, no handwritten signature will be required for the delivery of the following postal and package delivery services: control letters, form signatures, control letters with return notice, express letters, letter with reception notice, public notary letters, packages, shipping, credit cards, door to door services, telegrams and registered letters.

In that regard, ENACOM set forth certain requirements that the postman or distributor will have to comply with, namely:

1. Control letters, form signatures, control letters with return notice, express letters, letter with reception notice: Fill out full name and surname on physical or digital format.
2. Public notary letters, packages, shipping, credit cards, door to door services: In addition to complying with (1), the postman or distributor will have to verify the recipient’s national identification document from a prudent distance. Recipients can only be persons of 18 or more years of age who are in the residence.
3. Telegrams and registered letters: In addition to complying with (1) and (2), the postman or distributor will have to gather additional information to positively identify the recipient (e.g. photographs or a description of the place of delivery).
4. In buildings, all of the aforementioned postal and package delivery services can be received by the building’s personnel.

Furthermore, ENACOM required all postal and package delivery providers that they take adequate care of their employees by providing all available hygienic supplies and equipment. It also required that postal and package delivery service´s providers take special measures for cleaning the facilities through which they provide said services.
