On July 29, 2024, Resolution No. 710/2024 of the Ministry of Security was published in the Official Gazette of the Nation, establishing the Unit for Artificial Intelligence Applied to Security (“UIAAS”, for its Spanish acronym).

This new unit will operate within the Directorate of Cybercrime and Cyber Affairs, under the Cabinet of Advisors of the Ministry of Security. The UIAAS will be headed by the Director of Cybercrime and Cyber Affairs and will include representatives from the Federal Police and Security Forces.

The mission of the UIAAS is to prevent, detect, investigate, and prosecute crimes through the use of artificial intelligence. Its main functions include:

– Patrolling social networks, applications, and websites, as well as the “Deep Web” or “Dark Web,” to investigate crimes and detect security risks.

– Identifying and comparing images in physical or virtual formats.

– Analyzing real-time images from security cameras using facial recognition.

– Using machine learning algorithms to predict and prevent future crimes.

– Detecting cyber threats before attacks occur, including malware and phishing.

– Processing large volumes of data to create profiles of suspects and establish links between different cases.

– Using drones for aerial surveillance and responding to emergencies.

– Performing dangerous tasks, such as bomb disposal, using robots.

– Improving communication and coordination among the Federal Police and Security Forces.

– Analyzing activities on social networks to detect potential threats and anticipate disturbances.

– Detecting suspicious financial transactions that could indicate illegal activities.

The implementation of the UIAAS will adhere to the guidelines and directives established by the Ministry of Security Resolution No. 428/24.

Please note that, according to Ministry of Security Resolution No. 428/24, during preventive operations, police personnel must comply with the Personal Data Protection Law No. 25.326. Similarly, the resolution emphasizes that (i) it is strictly prohibited to handle sensitive data without judicial authorization or use publications involving minors without proper permission, and (ii) if it is detected that preventive activities involve a minor, these activities will be immediately suspended and the corresponding authorities will be notified, unless there is a risk to the minor’s life.

Regarding the scope and limits of the new UIASS’s actions, particularly when using technological tools for the prevention of criminal behavior, a careful analysis is required, taking into consideration potential issues related to the right to privacy and the validity or legality of the actions of the security forces.
