Consumer Protection Department report | New Consumer Protection Regulations

Dear Sir or Madam,

During the past week, a number of regulations related to consumer protection have been issued:

• Resolution No. 137/2020 of the Trade Secretary, issued on May 20th, establishes a remote proceeding for carrying out mediations (SICOME) related to the COPREC related regime.

This regulation deals with procedural aspects related to the functioning of the system adopted in order to conduct electronic proceedings, including notices, special addresses, hearings, terms of the proceedings, and formal approval (“homologación”) of the settlement agreements eventually reached by the parties.

• Resolution No. 139/2020 of the Trade Secretary, issued on May 28th, establishes a class of “ultra vulnerable” consumers that are not included in the Argentine Consumer Protection Act.

Although this regulation does not create any rights that trigger obligations for the companies to which Consumer Protection regulation applies, it does establish a number of procedural principles that could shape future regulations that give this class of consumers priority in the resolution of certain claims.
