Resolution No. 756/2023 of the National Communications Entity (“ENACOM”), published in the Official Gazette on May 24th, 2023, declares the frequency band ranging from 5925 MHz to 7125 MHz as shared use within the national territory, without individual authorization requirements for the operation of wireless access systems, including local radioelectric networks (the “Resolution”). The Resolution applies to the operation of systems for exclusive indoor use, whether private or for the provision of ICT services.
Furthermore, the Resolution approves the technical aspects of the equipment and systems operating in the frequency band from 5925 MHz to 7125 MHz, as detailed in the annex titled “Characteristics of wireless access systems, including local radioelectric networks”.
Additionally, the Resolution establishes that the provision of ICT services using the shared radio frequency band requires holding the corresponding license and registering the service, in accordance with the requirements set forth in the Regulations for ICT Service Licenses approved by Annex I of Resolution MM No. 697/2017. It also states that equipment models must be registered in the Telecommunications Activities and Materials Register (RAMATEL).
Finally, the Resolution stipulates that the emissions from systems authorized under it shall not cause interference to authorized stations of a service attributed with primary category, nor claim protection against harmful interference caused by stations of a service attributed with primary category.
