On April 1, 2025, the National Service of Agri-Food Health and Quality (SENASA), through the Secretariat of Agriculture, Livestock, and Fisheries, approved Resolution 214/2025 (the “Resolution”), which establishes a new procedure for the registration of fertilizers, amendments, and related products in Argentina. This regulation aims to ensure quality and safety in the production and commercialization of these products, as well as to streamline import and export processes.

1-Key Aspects of Resolution 214/2025

1.1- Creation of the Registration Procedure

The resolution approves a simplified self-managed registration procedure with immediate issuance of registration for individuals and legal entities involved in the manufacturing, packaging, distribution, importation, or marketing of fertilizers, stimulants, amendments, substrates, inoculants, conditioners, protectants, and raw materials, as well as the facilities where these activities are carried out, pursuant of Chapter I of the Technical Manual annexed to this Resolution,

1.2- Scope

The requirements of the Resolution apply to a broad range of products, specified in Annex I. These products include chemical and biological fertilizers, amendments, substrates, inoculants, and more.

1.3- Registration of Individuals and Establishments

The registration of Products is also carried out via sworn declaration through the TAD platform. SENASA has a period of 10 business days to respond; if no response is issued within that timeframe, the application is deemed approved under the concept of positive silence. Once registered, the product is authorized for commercialization and its corresponding Certificate of Registration is issued.

1.4- Distributors and Marketers

-Simplified Imports: Products already registered in countries that are part of the Commonwealth of Australia, the United States of America, New Zealand, the United Kingdom of Great Britain and Northern Ireland, the Federative Republic of Brazil, the European Union, and the State of Israel, as listed in Annex I of Decree 101/2025, may be imported via self-managed process through the TAD platform.

-Non-Simplified Imports: Products not included in the simplified import regime require prior authorization, which will be granted within a maximum period of 5 business days, as detailed in the Technical Manual.

-Exports: The Product Registration Certificate is sufficient to authorize export operations. For samples, a special authorization note issued by SENASA will be required.

 1.5-Commercialization of Ammonium Nitrate

Shipments of more than 50 tons of fertilizers containing ammonium nitrate must be previously notified to SENASA through the TAD platform.

2-Additional Considerations

-Effective Date: The Resolution enters into force 60 calendar days after its publication in the Official Gazette, i.e., on June 2, 2025.

-Technical Manual Approved as Annex I: The Resolution approves a Technical Manual that outlines specific procedures for the registration of individuals, facilities, products, and import/export operations, as well as relevant technical definitions for bio-inputs, semiochemicals, biological control, among others.

-Sampling Costs: Costs for the extraction, shipment, and laboratory analysis of samples collected by SENASA as part of the oversight process will be borne by the company holding the registration.

-Bio-inputs with Multiple Functions: If a bio-input serves more than one function (e.g., amendment and protectant), it must meet the requirements applicable to each function (Art. 12).

-Sanctions for False or Adulterated Information: The detection of false, incomplete, or adulterated data in sworn statements will result in automatic cancellation of the registration, without prejudice to other applicable administrative sanctions.

-Sanctions for Non-compliance: Sanctions for breaches will be applied in accordance with Chapter V of Law 27.233 and related regulations.

-Regulatory Amendments: This Resolution partially replaces Resolutions 75/2019 and 1004/2023 and expressly repeals Resolutions 431/2024 and 657/2024, unifying registration criteria and simplifying procedures for fertilizers, bio-inputs, and other agricultural inputs.
