On February 20, 2025, Resolution No. 11/2025 (the “Resolution”, available only in Spanish here) of the Secretariat of Innovation, Science, and Technology, under the Chief of Cabinet of Ministers, was published in the Official Gazette. The Resolution introduces significant changes to the regulation of digital signatures in Argentina, repealing Resolutions No. 116/2017, No. 42/2019, and No. 946/2021, and approving a new version of the technical documents for digital signature implementation.
The repealed regulations were the following:
-Resolution No. 116/2017: Required the capture of a digital facial photograph and fingerprint of applicants and subscribers of digital signature certificates.
-Resolution No. 42/2019: Approved the “Technical Guidelines and Procedures for Fingerprint and Digital Facial Photograph Capture and Verification”.
-Resolution No. 946/2021: Established complementary procedures and technical guidelines for the Regulatory Framework for Licensed Digital Signature Certifiers.
The Resolution allows remote identity validation, eliminating the requirement for in-person presence before a Registration Authority for the issuance, renewal, or revocation of digital signature certificates. This was already permitted under Sections 21 and 27 of the Annex to Decree No. 182/19, as amended by Decree No. 743/2024.
The Resolution approves a new version of the technical documents for digital signature implementation, which include:
-Procedures and Complementary Technical Guidelines for the Digital Signature Regulatory Framework for Licensed Certifiers.
-Requirements for Certifier Licensing to Operate with Digital Signatures.
-Unified Certification Policy.
-Certificate Profiles and Revoked Certificate Lists.
-Minimum Content of Subscriber Agreements.
-Minimum Content of Terms and Conditions for Third-Party Users.
-Fees and Surety Insurance Amounts.
-Minimum Content of the Privacy Policy.
Finally, Section 10 of the Resolution establishes a 30-business-day deadline for Licensed Digital Signature Certifiers to submit their new Unified Certification Policy in compliance with current regulations. During this period, certifiers may continue issuing, renewing, or revoking Digital Signature Certificates.
