On December 3, 2024, Resolution No. 5744/2024 (the “Resolution”) was published in the Official Gazette, establishing specific requirements for electronic or digital prescription repositories in Argentina (the “Repositories”).
The Resolution mandates that Repositories must allow access to stored prescriptions from any authorized pharmacy in the country where the patient seeks dispensing, limiting access exclusively to the prescriptions required at the time of dispensing.
Additionally, the Resolution requires Repositories to enable all prescription platforms or systems to store their issued prescriptions within their repository, subject to the patient’s coverage. This must be facilitated through public application programming interfaces (APIs), with the necessary technical documentation made available through easily accessible channels. Repositories must also implement a process to authenticate prescription platforms and/or systems within ten (10) business days of receiving a request for integration.
Conversely, prescription platforms and/or systems are required to adopt the necessary measures to connect with Repositories corresponding to the patient’s coverage, ensuring proper interoperability of information and safeguarding the patient’s rights.
The Resolution also expands upon Article 4 of the Annex to Decree No. 98/2023, requiring Repositories to meet the following technical and administrative standards:
-High operational availability.
-Data persistence for stored prescriptions during the specified period, with robust backup and recovery mechanisms to ensure the integrity and reliability of information against potential failures or incidents.
Furthermore, the Resolution authorizes the Undersecretariat of Epidemiological Surveillance, Health Information, and Statistics to implement Repositories for electronic prescriptions issued without coverage from social security providers, prepaid medicine companies, or other health system agents. This includes facilitating collaboration agreements with public or private entities, provided there are no associated budgetary costs.
This Resolution aligns with the Argentine health system’s goal of achieving digitalization, standardization, and interoperability of healthcare information.
