Decree No. 89/2024, published in the Official Gazette on January 29th, 2024, orders the intervention of the National Communications Entity (ENACOM, for its acronym in Spanish), an autonomous and decentralized entity within the scope of the Secretariat of Innovation, Science and Technology of the Chief of Cabinet of Ministers, for a one-hundred-eighty-day period, with the possibility of a single extension. For this period, Mr. Juan Martín Ozores has been appointed ENACOM’s intervenor, while Ms. Patricia Zulema Roldan and Mr. Alejandro Fabio Pereyra have been appointed deputy intervenors.
In performing their duties, the intervenor and the deputy intervenors will jointly have the powers provided by the Enforcement Authority of Laws No. 26.522 and No. 27.078, as well as those established in the intervention decree. Their responsibilities include preparing a report on the current state of ENACOM, surveying judicial and administrative processes in which the entity is involved, evaluating the organizational structure, and proposing relevant modifications.
They must also analyze the consequences of the Necessity and Urgency Decree No. 690/20, propose a functional and operational reorganization of ENACOM, and evaluate the status of the Universal Service Trust Fund and the Competitive Promotion Fund for Audiovisual Media, among other tasks. This set of actions aims to improve the efficiency, quality, and accessibility of communication services within the framework of current laws and regulations.
