Dear Sir or Madam,
On December 21st, the Official Gazette published Decree No. 73/2023 of the National Public Administration (the “Decree”), through which, among other matters, it was decreed to replace Section XIII of Annex I – Organizational Chart of the National Centralized Administration up to the Undersecretary level – approved by Article 1 of Decree No. 50 of December 19, 2019, and its amendments.
In this sense, with the said section, the creation within the scope of the Ministry of Infrastructure was approved for (i) the Secretariat of Communications and Connectivity, (ii) the Undersecretariat of Communications and Connectivity Policies, as well as (iii) the Undersecretariat of Communications and Connectivity Planning.
It’s worth noting that Guillermo Ferraro will be the head of the Ministry of Infrastructure, while Ignacio Cingolani will oversee the Secretariat of Communications and Connectivity.
Furthermore, the Decree outlines the objectives of each of the new Subsecretaries:
Undersecretariat of Communications and Connectivity Policies
1. Assist the Secretariat in defining the criteria for updating the regulatory frameworks of telecommunications services, satellite services, audiovisual communication, and postal services.
2. Assist the Secretariat in drafting projects and issuing regulations regarding licenses, authorizations, permits, or registrations of services, as well as in their issuance.
3. Assist the Secretariat in interpreting the technical standards that regulate telecommunications, postal services, audiovisual and digital communication services.
4. Promote the issuance of regulations that encourage and stimulate competition, as well as prevent and discourage monopolistic practices, anti-competitive behaviors, predatory actions, and/or abuses of dominant position.
5. Advise the Secretariat in issuing regulations that govern postal services and aim to develop lightweight logistics distribution.
6. Participate in designing programs for the allocation of resources from the universal service fund.
Undersecretariat of Communications and Connectivity Planning
1. Recommend alternatives for the appropriate use of the infrastructure of the Argentine Satellite Solutions Company (ARSAT) Network and satellite development.
2. Participate in proposals for updating the National Spectrum Allocation Table.
3. Assist the Secretariat in representing the National State before the corresponding international organizations regarding telecommunications matters.
4. Provide advice in the development of fee, tariff, and rate regimes for services within its competence.
5. Propose measures to promote connectivity, universal access, and optimize the use of existing facilities and networks, emphasizing the sector’s needs and fostering the formation of working groups that involve relevant stakeholders.
