Dear Sir or Madam,
On May 13, 2020, Administrative Decision No. 765/20 (“Administrative Decision”) issued by the Chief of the Cabinet of Ministers was published in the Official Gazette (“BO”). This Administrative Decision adopts the recommendations made by the Committee of Evaluation and Monitoring of the Program of Assistance of Emergency to Work and Production (the “Committee”) in Act No. 10.
The Administrative Decision provides:
(i) that in order to carry out the calculation corresponding to the Complementary Salary for May 2020, it is appropriate to take as reference the remunerations paid in March 2020.
(ii) that to determine the employers’ eligibility, the variation of their billing level will be determined comparing the April 2019 period with April 2020, except for those companies that started their activity after May 1, 2019, in which case the comparison will be made with respect to the December 2019 period. Those companies that started their activity during 2020, shall still be considered as “activities critically affected” and will directly access the benefit.
