Dear All,

On August 20, 2024, Decree No. 743/2024 (the “Decree”, available only in Spanish here) was published in the Official Gazette, which establishes some amendment to Decree No. 182/19 regulating digital signatures. From now on, identity verification may be done remotely.

Section 2 of Article 21 of Decree No. 182/19 provided that “[t]he verification of identity data must be done in person, by means of biometric data determined by the Secretariat of Administrative Modernization…”. The new Decree modifies this passage, mentioning that “[s]uch verification may or may not be made in person, for which purpose real-time identity validation services using RENAPER data comparison shall be used”.

In addition, Article 27 of Decree No. 182/19 ruled that “[t]he physical presence of the applicant before the Licensed Certifier or its registration authorities shall be an unavoidable condition for the fulfillment of the necessary formalities for the issuance of the corresponding digital certificate”. Contrary to this, the new Decree rules that this condition is no longer necessary.
