Dear Sir or Madam,
On June 29th, 2023, the Executive Branch sent to the National Congress Message No. 87/2023 with the “Personal Data Protection Bill” (the “Current Project”), with the aim of updating the current Personal Data Protection Law No. 25.326 (the “LPDP”). The Current Project presents a few modifications with respect to the project published by the Agency for Access to Public Information in February of this year (the “Previous Project”).
The following are among the main modifications introduced by the Current Project:
• Renaming of the enforcement authority, from “Agency for Access to Public Information” to “Agency for Access to Public Information and Protection of Personal Data”.
• The increase in the age of valid consent for minors, from thirteen (13) years to sixteen (16) years.
• The change in the adaptation period to the new regulation. The Previous Project provided for a period of one (1) year and the Current Project provides for a period of one hundred and eighty (180) days. Notwithstanding the foregoing, the sanctions incorporated will be operational as of publication.
