Labor & Social Security Law Department Report | Salary Agreement 2022 for Trade Employees

Dear Sir or Madam,

On May 3rd, 2022, the Ministry of Labor, Employment and Social Security issued Resolution No. 826/2022, whereby the salary agreement that entered into force on March 31st, 2022 (the “Agreement”), signed by the Argentine Federation of Trade and Service Employees (“FAECyS”), the Argentina Confederation of Medium-Sized Enterprises (“CAME”) and the Union of Argentine Commercial Entities (“UDECA”) was officially approved.

The aforementioned Agreement sets the following guidelines:

a) The granting of an annual non-remunerative salary increase of 59.5% over the basic salary scales of the Collective Bargaining Agreement (CCT) 130/75, taking the values of April 2022 as the basis for calculation.

b) The non-remunerative increase is non-cumulative and it will be paid in seven stages:

• 6% in April 2022
• 6% in May 2022
• 6% in June 2022
• 10% in August 2022
• 10% in September 2022
• 11% in November 2022
• 10.5% in January 2023

c) These increases will be incorporated into the salary scales in April 2023. Until their incorporation into the salary scales, the amounts will only generate:
(i) Withholdings and contributions to OSECAC
(ii) Employees’ contributions for union purposes and union dues, which will be calculated over the nominal amount of each increase.

d) The agreed increases will not have an impact on the additional benefits of the Collective Bargaining Agreement (CCT) 130/75 such as attendance (“presentismo”), seniority, and cashier, among others, nor on the 13th Month Salary until their incorporation into the basic salary in April 2023.

e) Only those increases granted to the employees by the employers in a unilateral manner as of January 1st, 2022 that would have been paid on account of the increases determined by the Agreement may be absorbed or set off until their attendance.

f) The payment of the additional contribution by the employers equivalent to the sum of ARS 600 for each employee included within the Collective Bargaining Agreement 130/75 is extended throughout the duration of the Agreement. The aforementioned contribution will be paid from April 2022 to March 2023.

g) Finally, the increase will be paid under the name of “Non-remunerative increase Agreement 2022″.
